Terms of Use

These Terms of Use govern your access to and use of Datastory's platform, services, and websites operated by Datastory Tech AB.

1. Acceptance of Terms

By accessing or using Datastory's platform and services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Datastory Tech AB, a company incorporated in Sweden. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Datastory provides a cloud-based platform for data storytelling, including:

  • Data Visualization Tools: Create charts, graphs, and interactive visualizations
  • Content Management System: Organize and publish data stories and narratives
  • Website & Application Builder: Build and publish data-driven websites and applications
  • Open Data Access: Access to curated datasets and open data sources
  • AI-Powered Analysis: Automated insights and data analysis capabilities
  • Publishing & Sharing: Tools to publish and share your data stories publicly
  • Collaboration Features: Team collaboration and project management tools

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice to users.

3. User Accounts and Registration

3.1 Account Creation

To access certain features of our platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

3.2 Account Eligibility

You must be at least 16 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's consent to use our services.

3.3 Account Suspension

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for other legitimate business reasons. We will provide reasonable notice when possible.

4. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not:

  • Upload or share content that is illegal, harmful, threatening, abusive, or defamatory
  • Share content that infringes on intellectual property rights of others
  • Distribute spam, malware, or other malicious content
  • Share personal information of others without consent
  • Publish false, misleading, or deliberately deceptive information

4.2 Prohibited Activities

  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use our Services to send unsolicited commercial communications
  • Interfere with or disrupt our Services, servers, or networks
  • Reverse engineer, decompile, or attempt to extract our proprietary technology
  • Use automated tools to access our Services without permission
  • Violate any applicable laws or regulations

5. Your Content and Data

5.1 Ownership

You retain ownership of all content and data you upload to our platform ("User Content"). This includes datasets, visualizations, stories, text, images, and any other materials you create or upload.

5.2 License to Datastory

By using our Services, you grant us a limited, non-exclusive, royalty-free license to:

  • Store, process, and display your User Content as necessary to provide our Services
  • Back up and secure your User Content
  • Provide technical support and troubleshooting
  • Enable sharing and publishing features when you choose to use them

5.3 Your Responsibilities

You are responsible for ensuring you have the right to upload and use any data or content on our platform, including:

  • Compliance with applicable data protection laws (GDPR, CCPA, etc.)
  • Obtaining necessary permissions for using third-party data
  • Ensuring accuracy and legality of your content
  • Respecting intellectual property rights of others

6. Intellectual Property Rights

6.1 Datastory's IP

The Datastory platform, including all software, designs, text, graphics, user interfaces, and other content, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our proprietary content without explicit permission.

6.2 Open Source Components

Our platform may include open source software components. These components are governed by their respective licenses, which are incorporated by reference.

6.3 Copyright Infringement

We respect intellectual property rights. If you believe your copyright has been infringed, please see our DMCA Policy for information on how to submit a complaint.

7. Payment Terms

7.1 Subscription Plans

We offer both free and paid subscription plans. Paid plans provide additional features, storage, and capabilities. Current pricing is available on our website.

7.2 Billing and Payment

  • Subscription fees are billed in advance on a monthly or annual basis
  • Payment is processed by secure third-party payment processors
  • You are responsible for all taxes associated with your subscription
  • Failed payments may result in service suspension

7.3 Refunds and Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period.

If you are a consumer residing in the EU or Sweden, you have a statutory right to withdraw from a subscription purchase made online within 14 days of the purchase without giving any reason. To exercise this right, you must notify us before the withdrawal period expires. If you request that the service begins during the withdrawal period and then withdraw, you may be charged a proportionate amount for the service provided up until the time you notify us of your withdrawal.

Refunds will be made in accordance with applicable law. We do not provide refunds for partial months except where required by law or in cases of service failure.

8. Service Availability and Maintenance

We strive to maintain high service availability but cannot guarantee uninterrupted access to our platform. We may temporarily suspend access for:

  • Scheduled maintenance and updates
  • Emergency security measures
  • Technical issues beyond our control
  • Legal compliance requirements

We will provide reasonable advance notice of planned maintenance when possible. For critical issues, we will work to restore service as quickly as possible.

9. Disclaimers and Warranties

IMPORTANT: Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

9.1 No Warranties

To the maximum extent permitted by law, we disclaim all warranties, including:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that our Services will be uninterrupted or error-free
  • Warranties regarding the accuracy or completeness of content
  • Warranties that our Services will meet your specific requirements

9.2 Third-Party Content

Our platform may include access to third-party data sources and content. We do not warrant the accuracy, completeness, or reliability of such third-party content and are not responsible for any errors or omissions.

10. Limitation of Liability

IMPORTANT LIMITATION: To the maximum extent permitted by law, Datastory's total liability to you shall not exceed the amount you paid for our Services in the 12 months preceding the claim.

10.1 Excluded Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Business interruption or downtime
  • Reputational harm or lost goodwill

10.2 Exceptions

These limitations do not apply to damages caused by our gross negligence, willful misconduct, or violations of applicable law where such limitations are prohibited.

11. Indemnification

You agree to indemnify, defend, and hold harmless Datastory, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from: (a) your use of our Services, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any rights of another party.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion features in your dashboard. Upon termination, your access to paid features will continue until the end of your current billing period.

12.2 Termination by Datastory

We may suspend or terminate your account if you:

  • Violate these Terms or our policies
  • Fail to pay applicable fees
  • Engage in fraudulent or illegal activities
  • Create security risks or technical issues

12.3 Effect of Termination

Upon termination, your right to use our Services will cease immediately. We will provide reasonable opportunity to export your data, typically 30 days after termination. Some provisions of these Terms will survive termination, including intellectual property rights and limitation of liability.

13. Changes to These Terms

We may modify these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending email notifications to your registered email address
  • Displaying in-app notifications when you next access our Services

Your continued use of our Services after changes become effective constitutes acceptance of the new Terms. If you don't agree to the changes, you may terminate your account.

If you do not agree to the changes, you may terminate your account immediately and without penalty. Your continued use of the Services after changes take effect will constitute your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of Swedish courts.

14.2 Dispute Resolution

Before initiating formal legal proceedings, we encourage you to contact us to try to resolve any disputes informally. Many issues can be resolved quickly through direct communication.

BIf you are a consumer in Sweden, you may also bring disputes to ARN (Allmänna reklamationsnämnden) or via the EU’s Online Dispute Resolution platform.
